These Terms and Conditions (“Terms”) govern the direct orders ("Order") placed with Trestle Labs (“we”, “ us”, “our” or “Trestle Labs”) for its products, services and subscriptions ("Products") through Trestle Labs store website (https://store.trestlelabs.com), Google Play Store, App Store or any other electronic payment platforms. Please read these Terms carefully before placing your Order with Trestle Labs for any of its Products. By submitting your Order, you agree to be legally bound by the terms and conditions set out on this page.
These "Terms and Conditions" constitute an electronic record within the meaning of the applicable law. This electronic record is generated by a computer system and does not require any physical or digital signatures.
GENERAL TERMS
1. Order Confirmation
When placing an Order for our Products, you may be required to provide certain information, such as your shipping address, email id, billing information and other additional details. You represent and warrant that all such information is accurate, and you shall ensure that such information is kept current. We shall have no responsibility or liability for inaccurate information or information that later becomes outdated, and shall have no obligation to make efforts to determine the correct information. You can update your information within 2r hours of placing your order by sending an e-mail to: info@trestlelabs.com. Once we receive your Order, we confirm your order via email or phone call before shipping.
2. Payment
You will be charged the full Price of the Products at the time of placing the Order.
3. Delivery Schedule
Although we make efforts to commence the shipment of your Order as soon as reasonably possible, you understand and agree that there may be delays. Your orders are shipped usually within 30 days of Order Confirmation from our side. If we are unable to commence shipping of your Order on or before 90 days of you placing the Order, we shall process a full refund to you. Your placing of an Order constitutes your agreement with us to process full refund in above mentioned circumstance of Delayed Delivery.
This 30-day estimated time of shipping is only an estimate, is subject to change due to multiple unavoidable circumstances, and we do not represent or warrant that we will be able to ship the Order by the estimated date. As a result, in the event that a delay arises and the estimated shipment and/or release of the product is not met, we are not responsible for any damages that may occur due to the delay, nor shall we be obligated, except as set forth in these Terms, to provide any discounts, refunds or credits due to any such delays. We will provide you periodical updates with respect to such delivery schedules. If for any reason you decide that you do not wish to continue to wait for your Order, you may cancel your reservation as provided for in Section 6 below.
4. Priority
We commence the shipping of Products according to the sequence in which the Order is received. However, this does not imply receiving a particular number associated with your Order. If you cancel or forfeit your Order in accordance with the terms of this Agreement, your position will be taken by the next person on the Product reservation list.
5. Price
The purchase price ("Price") is inclusive of all taxes and also includes shipping charges for delivering the Products anywhere in India. However, shipping charges will be extra and will be charged on actuals for delivering the Products anywhere outside of India.
6. Order Cancellation
You or Trestle Labs may cancel the Order at any time for any or no reason within the first 24 hours of placing your Order with us. Cancellations are not possible after 24 hours of placing an Order. In case of Order Cancellation, you will receive a full refund of the purchase Price without interest (and you will not pay any processing fee). Your placing of an Order constitutes your agreement with us to process full refund in above mentioned circumstance of Order Cancellation. Order Cancellation requests must be made via email to - info@trestlelabs.com.
7. Limitation of liability
Under no circumstances will Trestle Labs be held liable for any incidental, special or consequential damages arising out or related to this Agreement. In the event Trestle Labs is held liable for any damages arising out of or related to this Agreement, your sole and exclusive remedy will be the full refund of your purchase Price without interest.
8. Terms and Conditions of Sale
The purchase of Products is subject to additional terms and conditions provided by Trestle Labs in the ‘Product-specific Terms’ section below, including in respect of any software included in the Products or system specifications required by the product. The link to latest Terms and Conditions can be found on the checkout page, which is subject to change without notice. Your Order of the Product will be subject to these terms and conditions.
9. Distributors
We work with local distributors. If you place an order on our website or store, using a delivery location where one of our distributors is active, we might transfer the Product(s) and the corresponding delivery obligation to the distributor. In that case, these Terms remain in effect.
10. Age and Residency
You acknowledge that you are at least 18 years old and will take delivery of your Product. You acknowledge and agree that Trestle Labs will initially focus its service efforts on certain geographical areas, and may expand to other areas as the company grows.
11. Customer Information
We will use any information that we may collect about you only in accordance with our Privacy Policy.
12. Disclaimer
Trestle Labs ensures 100% Quality Assurance for the Products that we build. You understand and agree that the Product design and User-interface may at times, vary slightly with the introduction of newer versions due to the design improvements we make in accordance with customer feedback. However, the technical features and capabilities will continue to match the Product Description.
13. Changes to the Terms
Trestle Labs reserves the right to change any of the Terms for any or no reason from time to time. So, please review it periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. We may provide you additional forms of notice of modifications or updates as appropriate under the circumstances. These changes are effective immediately after they are posted on this page. You placing your Order with us will constitute your acceptance of such modification.
14. Miscellaneous Provisions
These Terms constitute the entire agreement between the parties pertaining to its subject matter and it supersedes all prior agreements, representations and understandings of the parties. This Agreement shall be governed by and shall be construed in accordance with the laws of India. The venue for any actions relating to the subject matter or enforcement of this Agreement shall be in Bengaluru, India, the place where this Agreement was entered and is to be performed. You may not assign this Agreement or any of the rights granted to you hereunder.
